These Terms of Service (“Terms”) govern your access to and use of the Tensu website, mobile application, web dashboard and related services (together, the “Service”). The Service is provided by Tensu (“Tensu,” “we,” “us” or “our”).
By creating an account or using the Service, you agree to these Terms. If you use Tensu for an organization, you confirm that you have authority to accept these Terms for that organization.
1. What Tensu provides
Tensu is software for organizing rental information and workflows, including properties, leases, rent records, documents, maintenance, inspections, communication and Rental Passports.
Tensu is not a party to a lease, property manager, letting agent, bank, rent-payment processor, escrow service, credit bureau, insurer or legal adviser. The Service does not guarantee a property, payment, document, user or rental outcome. You remain responsible for your agreements, decisions, checks and legal obligations.
2. Eligibility and accounts
You must be legally able to enter into these Terms and at least 18 years old. You must provide accurate account information and keep it current.
You are responsible for activity under your account and for protecting your sign-in credentials, email account and devices. Do not share credentials or allow another person to use your identity. Contact support@tensu.app promptly if you suspect unauthorized access.
We may require reasonable verification before restoring access, changing sensitive information or responding to an account request.
3. Tenant and landlord responsibilities
Users may act as tenants, landlords or both. You must invite only people who are entitled to access a property or tenancy and use personal data only for legitimate rental-related purposes.
You are responsible for checking the accuracy of property, lease, payment, maintenance, inspection and other records you submit or confirm. A confirmation records an action taken in Tensu; it does not replace bank evidence, a signed agreement or professional advice.
Landlords and tenants are responsible for complying with the housing, consumer, safety, tax, licensing, anti-discrimination and data-protection rules that apply to them.
4. Acceptable use
You must not:
- submit false, misleading, fraudulent or unlawfully obtained information;
- impersonate another person or misuse identity-verification features;
- harass, threaten, discriminate against or unlawfully monitor another person;
- upload content you do not have the right to use or share;
- expose another person’s personal data beyond what is reasonably needed;
- access accounts, records or systems without authorization;
- probe, disrupt, overload or bypass security or access controls;
- introduce malware or use the Service for unlawful activity;
- scrape or automate access except through a method Tensu expressly permits; or
- use a Rental Passport as a credit score, guarantee or substitute for checks required by law.
We may investigate suspected misuse and take proportionate action, including limiting access, preserving relevant evidence, removing unlawful content or suspending an account.
5. User content and permissions
You retain your rights in documents, messages, photos and other content you submit (“User Content”). You give Tensu a non-exclusive, worldwide license to host, copy, process, transmit and display User Content only as reasonably needed to provide, secure, support and improve the Service and to follow your sharing choices.
You represent that you have the necessary rights and permissions for your User Content. Do not upload unnecessary sensitive information. When you share content with another user or through a link, that recipient may be able to retain a copy even after access is revoked.
We may restrict or remove User Content when reasonably necessary to comply with law, protect the Service or enforce these Terms.
6. Rental Passports
A Rental Passport is a shareable summary of selected rental records and verification signals. It is informational and may be incomplete, disputed or out of date.
The account holder controls whether to create a share link and is responsible for choosing recipients. Recipients are responsible for using the information lawfully and fairly. Tensu does not make a rental decision for either party and does not guarantee the identity, reliability, creditworthiness or conduct of any user.
7. Subscriptions and billing
Some features require a paid subscription. Prices, included features, billing intervals, taxes and renewal terms are shown before purchase. Paid subscriptions renew automatically until canceled through the provider that bills you.
The separate Billing Policy explains renewals, plan changes, failed payments, invoices and refunds. The checkout terms and any mandatory consumer rights also apply. If there is a conflict about a purchase, mandatory law and the terms shown by the billing provider may take priority.
Deleting your Tensu account does not necessarily cancel a subscription billed by an app store or other provider. Cancel the subscription separately before the next renewal date.
Rent, deposits and utility payments recorded in Tensu are made outside the Service. Tensu does not hold or transfer those funds.
8. Tensu intellectual property
Tensu and its licensors own the Service, including its software, design, branding and documentation, excluding User Content. We give you a limited, personal, revocable, non-transferable right to use the Service in accordance with these Terms.
Feedback may be used to improve Tensu without restriction or payment, provided we do not identify you publicly as its source without permission.
9. Third-party services
The Service depends on third-party platforms and providers. Their terms and privacy notices may apply when you use their features, including authentication, identity verification, app-store billing or external links.
We are not responsible for a third-party service outside our reasonable control, but this does not limit any responsibility that cannot be excluded under applicable law.
10. Service changes and availability
We may add, change or discontinue features, introduce limits or perform maintenance. We will try to provide reasonable notice when a change materially reduces a paid Service, unless urgent security, legal or technical circumstances make advance notice impractical.
The Service may occasionally be unavailable. Do not rely on Tensu as the only copy of a lease, legal notice, emergency contact or document you are legally required to retain.
11. Suspension and termination
You may stop using Tensu at any time. You may request account deletion as described in the Privacy Policy.
We may restrict, suspend or terminate access when reasonably necessary because of material breach, unlawful activity, security risk, non-payment or a legal requirement. Where appropriate, we will provide notice and an opportunity to resolve the issue.
Termination does not remove obligations or rights that by their nature should continue, including payment obligations, intellectual-property provisions, disclaimers and liability terms.
12. Disclaimers
To the extent permitted by law, the Service is provided on an “as available” basis. Tensu does not warrant that every record is accurate, every user is trustworthy, the Service will be uninterrupted or a Rental Passport will be accepted by any recipient.
Nothing in these Terms excludes statutory rights or warranties that cannot lawfully be excluded.
13. Limitation of liability
To the extent permitted by law, Tensu is not liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity or decisions made by users based on information in the Service.
Tensu’s aggregate liability arising from the Service will not exceed the greater of the amount you paid Tensu for the Service during the 12 months before the event giving rise to the claim or EUR 100.
This limitation does not apply to fraud, willful misconduct, death or personal injury caused by negligence, infringement of rights that cannot be limited, or any other liability that applicable law does not allow us to exclude or limit.
14. Disputes and governing terms
Before starting formal proceedings, contact legal@tensu.app with a description of the issue so both sides can try to resolve it.
Governing law and forum: Nothing in these Terms deprives a consumer of the mandatory protections or the forum available under the law that applies to them.
If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver.
15. Changes to these Terms
We may update these Terms to reflect changes to the Service, law or business. We will post the revised Terms and update the date above. If a material change affects an active paid subscription, we will provide additional notice when required.
